BDO Responds to Liability Clause on its Terms and Conditions

While BDO is still reeling from the effects of the losses it incurred due to a massive hacking incident, a number of accountholders questioned a particular clause under its terms and conditions. Under the liability section, it said that BDO is not liable for any loss or damage “arising out of any improper, fraudulent access, or utilization of the BDO Electronic Banking Services.”

This particular section was widely talked-about, with a lot of users questioning whether BDO changed its terms and conditions after the hacking incident. As a response, BDO issued a statement on the questionable part of its terms and conditions, explaining that they did not change anything to its terms and conditions and that the liability clause is part of regular compliance in the banking industry.

While it stands by the liability clause under its terms and conditions, BDO added that it has made exceptions especially with the recent online hacking incident, where they shouldered their clients’ losses to maintain good customer relationships.

BDO has yet to disclose how much was lost due to the incident, but several cybersecurity experts suspect that the incident happened due to the bank’s aging online banking service that is due for phaseout in 2022. BDO president Nestor Tan said that they are working on a new version of their web service, which is slated to be available to the public by Q1 2022.
